Canadian working remotely in the US

Post by mmachemy »

Hello,

I am a Canadian citizen. Right now, I live in the US and am married to an American citizen. I am applying for my green card. I have a six-month contract with a Canadian provincial crown corporation. I work remotely. I am hired as a contractor, not an employee. All my work will be done remotely from the US, except for a few days of work that will have to be done in Canada. I earn Canadian dollars.

Note that I am a resident of the US as far as taxes. I believe I am also a resident of Canada as I have sufficient ties with Canada.

Where will I pay taxes?

Thank you!

IANAL but I think you have to pay Canadian taxes and your wife has to pay US taxes. If you get your green card, then you are allowed to operate your consulting business in the US. Then you must file with the IRS and then Canada until you file your final return. You must continue to remit GST on Canadian revenue to the CRA even after your final return.
For the fun of it...Keith
